May 7 2012: Daniel New Discusses Michael's Case

20120507MichaelNewPortraitMay 7, 2012 at 3p ET: We interview Daniel New, regarding the case of his son, former Spc. Michael New - the only soldier ever court-martialed for wanting to serve his own country instead of the United Nations.

What Happened to Michael will have an effect on every American soldier. On October 10, 1995, the 1/15 Battalion of the 3rd infantry Division of the U.S. Army came to attention at 0900 in Schweinfurt, Germany. All but one of the 550 soldiers were wearing a sky-blue baseball-style cap with a United Nations insignia on the front. One was wearing the olive-drab flat cap that is authorized to be worn with the Battle Dress Uniform. With this simple act of disobeying a direct order, Spc. 4 Michael New set the stage for a legal battle that has profound implications for the future of American soldiers into service of the United Nations without the constitutional permission of Congress.

A major issue for New's defense was PDD 25 - the secret Presidential Directive that Clinton signed detailing how the U.S. will serve with or under the United Nations in military operations. PDD 25 was cited by the prosecution to prove that the order given to New was a "lawful order." New's attorney rightly asked to see PDD 25 so he and New could learn just what the "law" of PDD 25 states.

But permission was denied by the Federal Government, since PDD 25 was classified at the time, and was not declassified until some 14 years later, after Bill Clinton was long out of office. We now have the original document and can prove that Clinton lied to Congress on this matter (who is surprised?), as to the nature of the deployments and the authority which he did NOT have to pull it off. Based upon that document, and our analysis of it, we expect to be back in court very soon.

Rest assured, this is not just one disgruntled soldier, unhappy over a Bad Conduct Discharge. The future of our military may rest on this case. Can a president delegate away the military of our nation to foreign interests? We understand that kings and dictators can do that - but our presidents take that same oath that every soldier takes - " support and defend the Constitution of the United States."

If our military can be traded like professional athletes, seconded to foreign agencies at the will of the president, then Congress has lost control, and the People have lost control, and the Constitution has become a meaningless document. It means that our national sovereignty is dependent purely upon the whim of the resident in the White House. That's a scary thought, particularly considering the last few residents!
